These Terms of Service (“Terms”) govern your access to and use of the Dalipila booking platform, including the mobile app, website at dalipila.app, and any branded business pages we host (collectively, the “Service”). The Service is operated by RJ&C Software Development Services, a sole proprietorship registered in the Philippines (“Dalipila”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What Dalipila is — and what it is not
Dalipila is a booking and payment platform that connects customers with independent service businesses (each, a “Business”) such as salons, barbershops, spas, and massage establishments. We provide the technology that lets you discover Businesses, reserve appointments, and pay for them.
We are not the provider of the services you book. The Business you book with is the provider, employer of its staff, and the party responsible for the quality, safety, and delivery of those services. Dalipila does not employ the staff of any Business, does not control how a Business performs its services, and does not guarantee any particular outcome. Any contract for services is between you and the Business; Dalipila is not a party to that contract.
2. Eligibility
You must be at least 18 years old and a resident of the Philippines (or another jurisdiction we explicitly support) to use the Service. By using the Service, you represent that you meet these requirements.
3. Your account
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at hello@dalipila.app if you suspect any unauthorized use. We are not liable for losses caused by your failure to keep your credentials secure.
You agree to provide accurate, current, and complete information when you create your account and to keep it updated.
4. Bookings and payments
4.1 Booking confirmation
When you select a service, time, and (where applicable) staff member, we hold the slot for up to 10 minutes while you complete payment. Your booking is confirmed only when payment succeeds and we receive notification from our payment processor.
4.2 Pricing and payment
Prices for services are set by the Business. Payment is processed by PayMongo using GCash, Maya, QR Ph, or card. We do not store your full card number. Once payment succeeds, the transaction settles to the Business as per our arrangement with PayMongo. Dalipila may receive a service-fee commission from the Business; this does not change the price you pay.
4.3 Cancellation by you
- You may cancel a booking free of charge up to 2 hours before the scheduled start time. Refunds, where applicable, are processed back to your original payment method within 5–10 business days.
- Cancellations within 2 hours of the start time may be subject to a late-cancellation fee determined by the Business, which we will display before you confirm the cancellation.
- If you do not show up for a booking (a “no-show”), the Business may charge the full service fee at its discretion.
4.4 Cancellation or change by the Business
A Business may cancel or reschedule a booking due to staff unavailability, illness, or operational issues. We will notify you and offer to reschedule or process a full refund.
4.5 Changes to staff assignment
Where you select a specific staff member, the Business will use reasonable efforts to honour that selection. If the assigned staff becomes unavailable, the Business may reassign your booking to another qualified staff member or, where you prefer, cancel for a refund.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Philippine law
- Make fraudulent bookings, engage in payment fraud, or attempt to manipulate prices or commissions
- Harass, threaten, or discriminate against any Business or its staff, or any other user
- Reverse-engineer, scrape, or copy the Service except as permitted by law
- Upload content that is unlawful, misleading, infringing, or harmful
- Use the Service to circumvent any security or authentication mechanism
We may suspend or terminate your account for violations of these rules. Repeat or serious offences may be reported to law enforcement.
6. Communications
By using the Service you agree to receive transactional messages necessary to deliver your bookings (confirmations, reminders, cancellations, payment receipts, security alerts) by SMS and email. You may receive marketing messages only after giving separate, explicit opt-in consent during signup or in your profile settings; you can withdraw that consent at any time without affecting transactional messages.
7. Reviews and content (future)
Where the Service later allows you to submit reviews, ratings, or other content, you grant Dalipila a non-exclusive, royalty-free, worldwide licence to host, display, and share that content in connection with operating the Service. You are responsible for the legality and accuracy of what you post.
8. Intellectual property
The Dalipila name, logo, software, and platform design are owned by us and protected under Philippine intellectual property law. You receive only a limited, revocable, non-transferable licence to use the Service for its intended purpose. Each Business owns its own brand assets, photos, and service descriptions and is responsible for ensuring it has the rights to display them.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by Philippine law, Dalipila disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components, or that any Business listed on the platform will deliver services to your satisfaction. We do not endorse any Business or staff member; listings are provided for booking convenience only.
10. Limitation of liability
To the maximum extent permitted by Philippine law, Dalipila’s aggregate liability arising out of or relating to your use of the Service is limited to the greater of (a) the total commissions Dalipila received from your bookings during the 12 months preceding the claim, or (b) PHP 5,000.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
We are not liable for the acts or omissions of any Business or its staff, including but not limited to the quality, safety, or legality of any service delivered to you.
Nothing in these Terms limits any liability that cannot be limited under Philippine law (such as for fraud or willful misconduct).
11. Indemnification
You agree to indemnify and hold harmless Dalipila, its affiliates, officers, employees, and agents from any claim, loss, or liability (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your violation of any law, or your infringement of any third party’s rights.
12. Termination
You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your account if you breach these Terms, if your account is involved in fraud or abuse, or if we are required to do so by law. On termination, sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.
13. Changes to these Terms
We may revise these Terms from time to time. When we make material changes, we will update the version and effective date at the top and notify registered users by email or in-app message. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Where law requires renewed consent, we will request it before the change takes effect for you.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Service will be brought exclusively before the courts of Cebu, Philippines, unless a different venue is required by law.
